Here are our terms and conditions, which apply to each job, unless otherwise noted: It is agreed by and between DroneX Solutions LLC and the authorizing party (customer and/or customer’s agent) that the following provisions are made as part of this contract:

Completion of Contract: DroneX Solutions LLC agrees to complete all requested services during the agreed upon timeframe. After completion of on-site work, DroneX Solutions LLC agrees to deliver the completed, post-work content to the client within one to three business days unless otherwise noted below.

Insurance: DroneX Solutions LLC maintains a $1 million liability policy through SkyWatch.ai during all UAS (Drone) operations. Coverage includes property damage, bodily injury, and privacy claims.

Licenses: DroneX Solutions LLC shall comply with all federal, state, and local laws, rules, and regulations with regard to necessary licenses, permits, and registrations in the performance of the services of this agreement. DroneX Solutions LLC shall ensure that they are in full compliance with the most current FAA regulations for the commercial operation of drones at the time of completing the task order. The Remote Pilot in Command (RPIC) shall maintain a Part 107 license during operations or directly supervise a drone operator without a Part 107 license.

Safety: DroneX Solutions LLC shall operate with safety in mind at all times. If the operation will endanger life or property, the operation of the service shall be terminated until there is no longer an endangerment to life or property. The RPIC has final say on if an operation may continue or not. In the event of weather conditions making the flight unsafe, the project will be postponed to a later time during that day or to another available day that is agreed upon by the client. No penalty will be held against the client.

Independent Contractor Status: It is expressly understood that DroneX Solutions LLC is an independent contractor of the client and does not hereby hire or rent the use of any of the client’s construction material, equipment, personnel or assume any liability for the use or method of use thereof.

Terms of Payment: Payment shall be made upon completion of the services by DroneX Solutions LLC, but prior to delivery of non-watermarked images/video. All content will be previewed by the client for acceptance. Once content is accepted by the client and payment has been made, non-watermarked content will then be delivered to the client through agreed upon means. Client shall pay the amount agreed upon below.

Real Estate Pricing: Pricing for real estate ground photography will be charged at $0.08/100 sqft or otherwise indicated. Square footage is determined by property records for the location.

Additional fees:

• Music: If the client wishes to include a specific music track, a fee for acquiring or use of the track will be posted to the client’s invoice without an additional fee other than the cost to acquire the rights of use.
• Addition editing: If the client wishes for additional editing after acceptance of the content, a fee of $50 will be required. Additional footage requested after acceptance of the content is provided at a rate of $60 per hour.
• Travel: For every mile traveled outside of 60 miles round-trip, a fee of $0.70 per mile (Federal Mileage Tax Rate) will be charged.

Tax: Effective March 14th, 2021, the Maryland Sales and Use Tax applies to the sales and use of a digital product or a digital code. The sales and use tax rate of a digital product or digital code is 6%.

Copyright: Copyright of all images and video remain with the property of DroneX Solutions LLC. DroneX Solutions LLC grants the client an irrevocable, un-assignable, royalty free interest in any and all images/video taken by DroneX Solutions LLC pursuant to this agreement. DroneX Solutions LLC reserves the right to use any image/video from the client’s project pursuant to this agreement for any advertising and marketing. 

Permits: The cost for acquiring a permit to operate at a specific location will be posted to the client’s invoice without an additional fee other than the cost to acquire.

Cancellations: The contract may be canceled at any time prior to the date of service at no charge. Cancelation after the date of service, but prior to delivery of the content will be at a rate of 50% of the contracted fee.
